Another win against counterfeiters took place on Monday. You may recall Louis Vuitton recently won its ITC case against defendants running a large counterfeit operation on the West Coast. Even more recently, Manhattan federal Judge Denise Cote awarded Hermès a $100 million judgment against these knockoff sites saying they were “liable for trademark infringement." A few of defendants' sites: HermesBagsOutlet.org, HermesBirkin-Bags.org, HermesOutletStore.com. In place of the fake Birkin and Kelly bags that graced these sites and the others that Hermes was granted permanent injunction over now bear an "under construction" message. Turns out only the Hermes team was in court on Monday as the defendants we no-shows.
So, what will Hermes actually get? Primarily, the cash held in the Web sites’ PayPal accounts will go toward paying the massive award. The judge ordered Google, Bing and Yahoo to stop providing links to the Web sites, and Facebook and Twitter were instructed to “de-index” and remove from any search results the defendants' sites.
