Jessica Simpson (aka - her shoe licensees: the Camuto Group and G-III Apparel Group, Ltd.) has knocked-off Christian Louboutin. Simpson's "Evangela" shoe, a hot pink sandal (above, right), was featured in the April 2012 issue of Elle Magazine, and it looks a little bit too much like Louboutin's "Staratata" sandal (above, left). Simpson's version is new for Spring 2012, while Louboutin's was a huge hit when it debuted in 2010. Luckily for Simpson, her take on the shoes do not have red soles or else things might get pretty ugly, especially because Louboutin is known for closely policing its trademark!
Not only are the shoes line-by-line knock-offs, Simpson herself sports the shoes in an ad for her e-commerce site. However, because Louboutin only has a trademark on the placement of the red on the sole of a shoe and Simpson's lacks the red sole, Louboutin has no recourse.
The vast majority of clothing and accessories are not eligible for any type of copyright-like protection in the U.S. So, without the red sole, Jess and her shoe licensees aren't technically doing anything illegal.
