Actress Katherine Heigl slapped Duane Reade with a $6 million-plus lawsuit this week, alleging that the NYC-based pharmacy giant misappropriated her likeness. The actress claims Duane Reade distributed a papparazzi photo of her leaving one of its stores with the following caption: “Love a quick #DuaneReade run? Even @KatieHeigl can’t resist shopping at #NYC’s favorite drugstore.” on its official Facebook and Twitter accounts without her “knowledge or approval.”
In addition to citing her position as a “highly successful television and motion picture actress, producer and celebrity”, the actress further alleges in her complaint that "as a consequence of her work in the entertainment and philanthropic worlds, plaintiff is a highly recognized celebrity. Accordingly, when plaintiff chooses to endorse a product or service, she is highly selective and well compensated.” The suit is seeking at least $6 million in compensatory and punitive damages.
