Sessions
Intellectual Property Principles & Practice
Intellectual property law is at the center of some of fashion’s most contentious disputes, from designer dupes to crackdowns on superfakes. This session will explore how brands use trademarks, copyrights, trade dress, and other IP rights to protect their designs and identities. Drawing on real-world cases, it will examine the limits of IP protection, the challenges of enforcement, and the role of brand heritage in building and protecting valuable IP portfolios.
Emerging Issues in Fashion Law
From AI-powered shopping agents and AI-generated imagery to the proliferation of dupes and the evolving resale market, fashion and retail businesses face new legal challenges. This session will explore the implications of agentic commerce, strategies for addressing lookalike products, and the evolving boundaries of product design protection. Drawing on recent disputes and industry developments, it will examine how brands are adapting their legal strategies to a changing marketplace.
Marketing, Advertising & IP in Practice
Viral influencer campaigns, celebrity endorsements, and bold advertising claims can create significant legal risks for fashion and consumer brands. This session will examine the rules governing influencer partnerships, advertising disclosures, promotional claims, and the use of third-party IP. Drawing on an in-house perspective, it will offer a behind-the-scenes look at how legal teams work with marketers to bring creative campaigns to market while managing legal and reputational risks.
Employment Law in Fashion & Retail
From high-profile executive departures and noncompete disputes to discrimination claims and employee misconduct, employment law plays a critical role in fashion and retail. This session will explore the legal challenges surrounding executive contracts, hiring and firing, restrictive covenants, workplace investigations, and employment litigation. Drawing on real-world disputes, it will examine how attorneys navigate sensitive workplace issues, manage legal and reputational risks, and advise brands when employment relationships break down.
